Did you know that State of California has guidelines as to the amount and duration of Spousal Support you may be entitled to, however Judges have broad discretion? Did you know that there are [2] types of Spousal Support; Temporary Spousal Support and Long Term/Post Judgment [Permanent] Spousal Support you may be entitled to?

Spousal Support may be one of the legal issues to be considered when you are going through your Divorce or Legal Separation. Whether you are entitled to Spousal Support or are trying to minimize your exposure, remember that the California Courts are under no obligation to award Spousal Support.

Long Term/Post Judgment [Permanent] Spousal Support is based on numerous factors including but not limited to: the marital standard of living, ability to pay, length of marriage and need, duration of the marriage, age and health of the parties, balance of the hardships to each party, goal that the supported party becomes self-supporting. When it can be shown that both parties have sufficient income or separate property to provide for themselves, it is unlikely that the Court will order Spousal Support. Other factors that may have a significant effect on the Court’s decision are issues of Child Custody and Domestic Violence.
