Our Law Firm Is Dedicated To Defending Your Rights

Has the Mother, Father or Legal Guardian of your child[ren] taken the Law into their own hands and abducted your child[ren]; fleeing the country of residence only to attempt to establish a residence in another country out of anger, revenge or with no regard for your child[ren’s] welfare? In this, day and age, unfortunately, International Child Abduction by one parent or Legal Guardian out of the country of residency is not uncommon. You are not alone in this terrible misfortunate nightmare. Or have you relocated with the children to another country [or to the U.S.] out of fear or with the consent of the other parent who now denies such consent? The legal issue regarding the ‘Convention on the Civil Aspects of International Child Abduction’, also known as the ‘Hague Convention’, can be very complicated.

Attorney BJ Fadem, with over 3 decades experience in Family Law understands the unique and complex procedures and process regarding International Jurisdiction. Depending on your situation, this can be a very complicated situation and there are many factors to be established and that apply to your situation. Furthermore, it can be a very long, complicated legal process.

Time is very important. Our Law Firm has established a network of experts from Washington DC, USA and throughout numerous countries around the world to assist in International Child Abduction and Jurisdiction legal cases over many years of successful Family reconnections.

The ‘Hague Convention’ is a treaty that many [but not all] countries have agreed to abide to, with regard to honoring each other’s Court Orders as well as assure the prompt return of a child[ren] wrongfully removed from their habitual country. Removal of a child[ren] is governed by the Courts of the countries who honor the ‘Hague Convention Treaty’. Neither party shall remove the minor child[ren] of the parties from the country for the purpose of changing the residence of the child[ren] permanently to a location outside of the country of residence, without the express consent of the other party, or with leave of the Court. To do so, a party must establish that the reason for leaving is bona fide and that he or she is planning to move in good faith and not for the purpose of undermining the Visitation arrangements existing between the child[ren] and the other party, and that the removal of the child[ren] to the new location will not be detritus to the best interests of the child[ren].

The ‘Hague Convention Treaty’ does not always protect a child[ren] taken out of the USA. The country where the child[ren] has been taken may not be a member of the ‘Hague Convention Treaty’. Even if they are, the hearing pursuant to the ‘Hague Convention Treaty’ can be deliberately delayed.

The reason I return time and time again is knowledgeable employees and the respect I am treated with. I also think that the noncondensending matter in which I was treated was a prime factor.

Are you and your partner considering second parent adoption to solidify your family unit? This heartwarming decision can provide incredible benefits for your child and your family as a whole.

What is Second Parent Adoption?

Second parent adoption is a legal process that allows a non-biological parent to formally adopt a child whose other parent is already legally recognized. It's a way to create a legally binding parent-child relationship, granting both parents equal rights and responsibilities.

Why Choose Second Parent Adoption?

🔒 Legal Protection: Ensures both parents have equal rights when making important decisions about your child’s healthcare, education, and well-being. This provides crucial legal protections in case of unforeseen circumstances.

🏡 Inheritance Rights: Guarantees that your child will inherit from both parents, just like any other biological family.

🌟 Family Unity: Creates a stronger sense of belonging and security for your child, reinforcing the message that they are loved and cherished by both parents.

⚖️ Equality: Recognizes the vital role both parents play in your child's life, fostering a sense of fairness and balance within the family.

At BJ Fadem Family Law, we understand the significance of this decision and are committed to guiding you through the legal process with care and expertise. Our experienced attorneys will work closely with you to ensure a smooth and successful adoption.

August is Child Support Awareness Month! This month, Fadem Law is here to bust some common myths and shed light on the truths of child support.

Myth: Child support is only for single mothers.

Truth: Child support is the financial responsibility of both parents, regardless of marital status or custody arrangements. It helps ensure a child's basic needs are met, including food, clothing, shelter, healthcare, and education.

Myth: Child support payments go directly to the receiving parent.

Truth: Child support is meant to benefit the child. In most cases, it's paid through a court-ordered system that ensures funds are used for the child's well-being.

Myth: If I don't see my child, I don't have to pay child support.

Truth: Your financial obligation to your child remains even if there's no visitation. Child support is about providing for your child's needs, not a payment for access.

Need help to understand your rights and responsibilities regarding child support? Fadem Law is here for you. Contact us today for a consultation!
