Our Law Firm Is Dedicated To Defending Your Rights

Creating a family is a wonderful experience and commitment. Our Attorneys will do the challenging legal work of the Adoption process for you. We will help you create the legal basis for your family. The Laws and issues regarding Adoption are complicated and ever-changing. Depending on your circumstances and needs, our Attorneys will advise you on how our law firm will handle this process on your behalf.

A new law in California allows the Court to acknowledge that a child may have more than just [2] legal or presumed parents. California will also acknowledge [2] or more parents who are of the same gender. Usually, if the parents are two [2] women, [1] the parent carries the child through a sperm donor. Some even choose to utilize an ovum from their partner. Two [2] male partners usually utilize a ‘surrogate’ to carry the child and choose which parent will donate the sperm. In that case, it is imperative that a ‘Surrogacy Agreement’ be drafted carefully wherein the chosen ‘surrogate’ has no parental rights and ensures that the child is relinquished to the ‘parents’ once the child is born. The best way to accomplish this is to utilize donated ovum – not the ‘surrogates’.

Many couples [whether heterosexual or homosexual] will opt for Adoption when conceiving a child on their own is impossible, improbable, and/or dangerous; or by choice.

Second Parent Adoption is an Adoption when one of the parents is the biological/legal parent of the child[ren] and their spouse/domestic partner chooses to become the legal parent of the child[ren]. This is different from an ‘independent’ Adoption in that the parents are either seeking a child already born that is not biologically or legally the child[ren] of either parent. Second Parent Adoption arises when the biological/legal parent re-marries and wants the new spouse to adopt the child[ren] or same-sex parents want to have a child[ren] together.

The reason I return time and time again is knowledgeable employees and the respect I am treated with. I also think that the noncondensending matter in which I was treated was a prime factor.

Not all restraining orders in California work the same way.Domestic violence restraining orders and civil harassment restraining orders apply to different relationships and follow different legal standards.Domestic violence protections generally apply to family members or partners.Civil harassment orders are typically used for neighbors, coworkers, roommates, or other individuals outside of a close relationship. In many situations, civil harassment cases require proof of a pattern of behavior, not just a single incident.Understanding these differences can make a significant impact if you are filing or responding to a restraining order.Follow @FademLaw for clear California family law insights.
How easy is it to get a restraining order in California? It depends on the type. For a civil harassment restraining order, one incident is usually not enough. You must show a pattern of harassment, threats, or abuse — and that it’s likely to continue. If the conduct stopped, or there’s no ongoing risk, the court is far less likely to step in.These cases carry a higher burden.Courts don’t issue restraining orders simply because there’s a dispute between people.Understanding the difference between “a conflict” and “a legal pattern of harassment” matters.
