You and the other part[ies’] in your legal issue are eager to settle your matter and are agreeable. However, you need a Mediator to settle and to assist all parties involved all your legal issues in your matter. Where do you turn to? Do you draw up your own agreement and go to a Notary for signature? Will this stand up in a Court of Law? Will ALL legal issues be covered in your notarized document in the future? Will this cover all your disputes, concerns, issues, legal issues, if Court complications arise? Will this document withstand and hold weight in a Court of Law, if necessary? You are correct to question this process of legal agreements, arrangements and settlements made without legal representation.

However, Mediation is a process that is less expensive than going through a Court Trial, it is usually faster than waiting for a Court’s Judge who will decide all your decisions for you. And neither party, during Mediation, is required to be represented by Counsel but may. All of this can be done without ever having to step into a Courtroom. The time frame for completion of the entire Mediation process to reach your goals will depend on the requirements of the legal issues.

Attorney BJ Fadem has been recognized as an International Mediator by UC Hastings Law School. Mediation can be used for all Family Law legal issues such as Child Custody & Visitation, Child Support, Divorce, Domestic Violence, Legal Separation, Property Division and Spousal Support. Helping bring parties’ disputes to early resolution and move the process as smooth, civil and uncomplicated as possible is the goal.

If your case is a high-conflict matter and/or the opposing party is not willing to settle the matter civilly or politely, Mediation may not be what you are looking for. Our Law Firm will not Mediate if both parties are not willing to submit to the process. Attorney BJ Fadem also cannot legally represent either party during Mediation.

There is a difference between Mediation and Arbitration. Mediation is the process by which parties can settle a legal dispute through a third party [Mediator] and compromise their issues with a fair settlement out of Court. Arbitration is a mini Trial held in an attempt to avoid a Court Trial and conducted by a person or panel of people who are not Judges.
