Going through a divorce is a very personal struggle. It’s not just about leaving the person you thought you would grow old with. Or the person you brought into your family. Or the person you may have had children with. When it comes down to Divorce, suddenly everything you believed was “sentimental” becomes “material”. Divorce consumes your life as did your marriage, yet now instead of connection, you feel betrayed, lonely and life feels fragile. So now you are faced with a daunting and most likely expensive Divorce. What do you do?
Are you concerned regarding:
Guardianship & Conservatorship Mediation
The only reason we list Criminal Defense, is because some of our cases have become Criminal issues, which we do handle.
On the subject of Domestic Violence, it can be subtle, or it can be obvious. If you come to any of our staff regarding this issue, we have resources and connections to instantly help and protect you from that situation. ‘It just takes a call’.
In a Divorce case, while you are going through the process, it is also important to consider your interim estate planning.
Many Father’s feel they do not have rights because of culture, religion, or social pressure. Yet, you may find the Law is on the side of the Father’s as much as the Mother’s in the USA and Abroad.
Delays often happen during the Divorce process; things like:
*Discovery (requesting, receiving and responding) formal information from the other side
*Numerous ‘Motions’ necessary to be filed on your behalf because the Opposing Party and or Opposing Attorney/Law Firm refuses to cooperate
*The above can take many months to years to resolve – depending upon how contentious the divorce is.
Many common questions regarding Divorce are:
Q: My Spouse and I have no children, no house, not much in the way of assets and were not married long. How do we get a simple Divorce?
A: If it has been 5 years or less from date of marriage to separation, you have no children, no jointly owned home and little or no assets, you may be eligible for a “Summary Dissolution” by filing a joint “Petition” together while paying just one filing fee.
Q: I’ve been served with a “Summons and Petition for Dissolution”. What do I need to do?
A: A “Response” has to be filed with the Court within 30 days or a “Default” may be taken against you and everything requested in the “Petition” will be granted as a “Judgment”.
Q: How long will it take to get my Divorce?
A: It will depend on numerous factors and the number of issues involved in your case. However, you cannot obtain a ‘Judgment of Divorce’ any sooner than 6 months from the date the other party has either been served with the ‘Summons and Petition for Dissolution’ or has appeared in the case by filing a ‘Response’ to the ‘Petition’.
Q: Can I move out of the State with my child(ren)?
A: This depends on many factors, the numerous factors may include:
- Custody & Visitation
- Child Support
- Spousal Support
- Property Division & Characterization
- Domestic Violence
- Restraining Orders
- International Jurisdiction
Our Law Firm also handles:
- Mail Order Brides from foreign countries, especially those brought over to the US under false pretenses
